Grants Requiring Legislative Consult

The Legislative reporting is in addition to reporting the grant application/receipt to OSBM.

Scenarios grant is reported to the NC General Assembly:

  1. Grants received by agencies can’t be budgeted or spent until after consultation with the Joint Legislative Commission on Governmental Operations if the grant:  
    • Exceeds $2.5M 
    • Requires state matching funds 
    • Or will be used for a capital project
       
  2. If the grant is less than $2.5 million and not specifically appropriated by the Current Appropriation Act, report within 30 days of receiving the grant to:
    • Joint Legislative Commission on Governmental Operations
    • The chairs of the Senate Committee on Appropriations/Base Budget
    • The chairs of the House Appropriations Committee
    • The Fiscal Research Division
       
  3. During an emergency, with OSBM approval, an agency can spend up to the greater of:
    • 1% of the total federal award; or 
    • $10 million
      Report to the following within 30 days of receipt of the grant:
      • Joint Legislative Commission on Governmental Operations
      • The chairs of the Senate Committee on Appropriations/Base Budget
      • The chairs of the House Appropriations Committee
      • The Fiscal Research Division
         
  4. When there is no appropriations act passed by the start of a new fiscal year and the state is operating under the Continuing Budget Authority, state agencies, with OSBM approval, can budget grants that are: 
    • Less than $2.5 million;
    • Do not require state matching funds;
    • And are not used for a capital project;
      Report to the following within 30 days of receipt of the grant:
      • the Joint Legislative Commission on Governmental Operations, 
      • the chairs of the Senate Committee on Appropriations/Base Budget,  
      • the chairs of the House Appropriations Committee, 
      • The Fiscal Research Division
