Public Comment on Periodic Review of Existing Council of State Rules

Pursuant to G.S. 150B-21.3A, Council of State is seeking public comment on its initial determinations as to whether its rules are "necessary" or "unnecessary."

G.S. 150B-21.3A requires state agencies to review their existing rules every 10 years in a process called "Periodic Review of and Expiration of Existing Rules." The first step in this process is for the agency to determine if each of their rules is necessary or unnecessary. 

  • A "necessary" rule is a rule other than an unnecessary rule.
  • An "unnecessary" rule is a rule that the agency determines to be obsolete, redundant, or otherwise not needed.

Council of State has determined that all its rules in Chapters 06 NCAC 01, 06 NCAC 02, and  06 NCAC 04 are "necessary.”

Public comments on these initial determinations may be submitted by email or mail any time during the public comment period. "Public comment" is defined by G.S. 150B-21.3A(a)(5) as a written objection to all of part of a rule. Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).
