The public is invited to submit comments on proposed amendments to select rules in 09 NCAC 03M (Uniform Administration of State Award of Grants) and the associated regulatory impact analysis. These rules govern administration of State awards to non-state entities. The amendments clarify requirements and noncompliance procedures to better align with agency practice and provide transparent procedures for petitions for rulemaking and declaratory rulings. The changes also provide greater regulatory certainty by specifying the version of the Code of Federal Regulations that applies to non-federal grant funds. Collectively, these revisions should promote consistent administration and oversight of State grant funds, support accountability and stewardship of public resources, and enhance transparency in future rulemaking decisions.

Comments may be submitted by email or mail any time during the public comment period, or they may be submitted in person at the public hearing. The proposed effective date for the amended rules is December 1, 2026.

Procedure for subjecting a proposed rule to legislative review

If an objection to a proposed rule is not resolved prior to the adoption of the rule, a person may submit written objections (via mail, delivery service, hand delivery, or email) to the Rules Review Commission requesting review by the legislature in accordance with G.S. 150B-21.3(b2).
