Liability Limit on Noneconomic Damages for Medical Malpractice

OSBM is required by G.S. 90-21.19 to reset the limit on damages for noneconomic losses related to medical malpractice on January 1 of every third year beginning with January 1, 2014.

The rate as of January 1, 2026 is $712,847. 

The statute requires the Revisor of Statutes to publish the new limit in an editor’s note to the statute.

The prior rate was $656,730 as of January 1, 2023.
